The Promoter

1. The promoter is Elanco New Zealand, 106 Wiri Station Road, Manukau, Auckland 2104, New Zealand (company no. 7851116) (Promoter).
    

Terms and Conditions of Entry

2. Information on how to enter the Neptra™ WIN a Firefly™ Video Otoscope promotion (Promotion) and the Prizes (defined below) form part of these terms and conditions.
3. Entry into the Promotion is deemed acceptance of these and any other applicable terms and conditions (together the Terms and Conditions). Any entry not complying with the Terms and Conditions is invalid.
    

How to Enter and Eligibility

4. The Promotion is open for entry by any Vet Council New Zealand (VCNZ) registered veterinarian (Participant) to win on behalf of the veterinary clinic branch that they are employed by (Vet Clinic/Branch). The Vet Clinic/Branch must be located in New Zealand to be elligible.
5. Employees and directors of the Promoter and (if applicable) the Promoter’s agency utilised in running the Promotion, and the immediate families of employees and directors of the Promoter and agency (if applicable) are not eligible to enter.
6. Participants must be registered on the learning platform VetSpace™ (this can be new or an existing registration). To be in the draw to win a Participant must:
   1. complete the Neptra™ Quiz on VetSpace™ (https://vetspace.nz/) between 15 August 2024 and 11:59pm 15 October 2024 (Promotion Period); and
   2. complete a Promotion entry form (Entry Form) providing the following information: (a) personal information including; name, email, phone number, (b) confirmation that the Participant’s Vet Clinic/Branch is agreeable to the Participant accepting the Prize on their behalf should they be a Prize winner, (c) selecting the region for the Vet Clinic/Branch from a drop down list and (d) naming the Participant’s Vet Clinic/Branch.  
7. If a Participant fails to complete all mandatory sections of the Entry Form, they will not be eligible to participate in the Promotion or receive a Prize. 
8. Only one Entry per Participant is permitted. Multiple entries into the Promotion are permitted for a single Vet Clinic/Branch subject to the following: (a) only one (1) entry permitted per Participant; and (b) each entry for individual Participants on behalf of a single Vet Clinic/Branch must be submitted separately and in accordance with the entry requirements.
9. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter for any reason by the relevant Closing Time and Date (defined below). Such entries will be deemed invalid.
10. The Promoter reserves the right, at any time, to verify the validity of entries and to request proof of a Participant’s eligibility (including a Participant’s VCNZ registration number).  If there is a dispute as to the identity or eligibility of a Participant, the Promoter reserves the right, in its sole discretion, to determine same. The Promoter may (in its sole discretion) disqualify any Participant who submits an entry that is not made strictly in accordance with the Terms and Conditions or tampers with the entry process.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.  The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
     

Promotion

11. The Promotion commences at 12.01am on August 15th 2024 and closes at 11:59pm on October 15th 2024 (Closing Date and Time). Entries must be received by the Promoter by the Closing Time and Date.
12. Each Prize draw will take place at 103 Onehunga Mall, Onehunga, Auckland 1061 on October 17th 2024 (Draw Date). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 
13. Entries will be divided into four regional categories (Regions): Upper North Island, Middle North Island, Lower North Island and the South Island. One Prize will be available to be won in each Region.  Each Draw-winner (Draw-winners) will be drawn randomly and separately after division into Regions and the winner for each Region will be the first eligible entry drawn from the Region’s entries. The Draw-winners and their Vet Clinic/Branch will both be contacted by the Promoter (or their agent) within ten business days of the Draw Date by telephone or email using the contact details provided by the Participant on the Promotion Entry Form. (A business day means a day that is not a Saturday, Sunday nor a public holiday in Auckland, New Zealand.) 
14. If a Prize is unclaimed because a Draw-winner and/or Vet Clinic/Branch cannot be contacted within ten business days following the Draw Date or if the Promoter determines that a Draw-winner is not eligible to participate in the Promotion, the Prize may, at the Promoter’s sole discretion, be forfeited and redrawn.  The Promoter is not responsible if the Draw-winner and/or Vet Clinic/Branch cannot be contacted within ten business days after the Draw Date.
15. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right to the fullest extent permitted by law to: (a) disqualify any Participant; or (b) modify, suspend, terminate or cancel the Promotion, as it deems appropriate.
16. Draw-winners consent to the Promoter using their details in any media for the purposes of promoting the Promotion and Neptra for an unlimited period of time without remuneration.
     

Prize(s)

17. There are four  Firefly™ Veterinary Video Otoscope Bundles to be won (each a Prize).
18. Further technical details of the items included in Prize can be found at https://fireflyglobal.com/. Items included are the DE551 Firefly™ Wireless Veterinary Otoscope, ES101 Veterinary Specula (Disposable), ES108 Veterinary Specula (Reusable) and ES140 Flexible Forceps.  
19. There will be one Prize to win in each Region managed by the Elanco NZ Pet Health territory managers. Refer to paragraph 13. above.
20. Each Prize is valued at NZD $1,490 and the total prize pool value is NZD $5,960. 
21. Prizes, or any unused portion of a Prize, can not be exchanged, negotiated, transferred or redeemed for cash, unless otherwise specified.  If the Prize (or any part of a Prize) is unavailable for any reason, the Promoter in its sole discretion reserves the right to substitute the Prize or part of the Prize with a prize of equal value and/or specification.
22. The Promoter’s decision on all matters will be final and no correspondence will be entered into.
23. The items included in the Prize may be used by the Promoter prior to distribution to the Prize-winner during marketing of the Promotion for demonstration purposes. 
     

Data Protection

24. By entering into the Promotion, the Draw-winner(s) acknowledge that the Promoter may be required to (or may wish to) make a public announcement by print or electronic media, which may include their Personal Information.
25. Entry into the Promotion acknowledges that the information used to register the Participant on VetSpace  and provided on the Entry Form is accessible to the Promoter, and its subcontractors or agents, for the purposes of the Promotion. The VetSpace™ registration contains data that allows the Participant to be identified, including name, address, and phone number (Personal Information). 
26. The Promoter, its subcontractors, and agents, will process the Personal Information to administer the Promotion and to notify a Participant if they are a Prize-winner. The Promoter may also use the Personal Information of Prize-winners in social media posts or other media forms from the Promoter. The Promoter will only pass the Personal Information to agents of the Promoter (including outside of New Zealand) in accordance with the Promoter’s Privacy Notice which is available at: www.privacy.elanco.com. 
27. By participating in the Promotion and providing the Promoter with Personal Information a Participant consents to use of the Personal Information and being notified if they are one of the Prize-winners.
     

Limitation of liability

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Fair Trading Act 1986, as well as any other implied warranties under the Consumer Guarantees Act 1993 or similar consumer protection laws in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any cost, expense, personal injury, loss or damage (including loss of opportunity and loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where such liability may arise out of the following:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 
    2. any theft, unauthorised access or third party interference; 
    3. any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; 
    4. any variation in Prize value to that stated in the Terms and Conditions; 
    5. any tax liability incurred by a Prize-winner or Participant; or 
    6. use of the Prize by a Prize-winner and any accompanying person or any other person.
        

General

29. These Terms and Conditions are governed by the laws of New Zealand and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the courts of New Zealand.
